Victory Workers Association (‘VWA’) is a trade union which represents the majority of employees employed by Yellow Mellow Sweets (‘YMS’). At the beginning of 2023, VWA and YMS concluded a collective agreement that stipulates that, for the years 2023 and 2024, employees would receive a 7% across-the-board wage increase. However, in August 2024, VWA approached YMS to negotiate an increase of 10%, arguing that 7% was not enough due to the high cost of living. YMS refused to negotiate with VWA, stating that there was already a collective agreement which catered for the wage increase in 2024. Members of VMA believe that YMS does not care about the well-being of its workers and have decided to engage in a strike action to put pressure on YMS to accede to their demands. does members of VMA may engage in a strike about the 2024 wage increase and whether the strike will be protected if they follow the procedure for a protected strike as prescribed by the LRA
